Sunderland defender Papy Djilobodji has been charged with violent conduct by the Football Association following an incident in his side's 2-0 defeat to West Brom at The Hawthorns.
Djilobodji appeared to strike West Brom captain Darren Fletcher in the 86th minutes of the game when the pair were waiting in the penalty box waiting for a free kick to be taken.
While referee Craig Pawson spoke to both players, he did not take any action, and the FA has claimed that he did not have a clear view of the incident.
As there is video footage the FA has charged the Sunderland defender with violent conduct.
"Off the ball incidents which are not seen at the time by the match officials are referred to a panel of three former elite officials," a statement from the FA read.
"Each panel member will review the video footage independently of one another to determine whether they consider it a sending-off offence.
"For retrospective action to be taken, and an FA charge to follow, the decision of the panel must be unanimous."
Djilobodji has until 6pm on Tuesday to respond to the charge.
